EFF fights for legalization of iPhone jailbreaking

Electronic Frontier Foundation (EFF) the firm that advocates personal freedom related to technologies has submitted a request to the Digital Millennium Copyright Act (DMCA) to make iPhone Jailbreaking legal.

jailbreak-is-legalPublic comments regarding the request are open till February 2, 2009 after which the Copyright Office will hold the hearings in California and Washington DC in spring 2009. The final ruling to the request is expected in October 2009.

EFF in the request argues that jailbreaking gives users the freedom of running applications provided by other developers not necessarily approved by the phone maker. In the argument, EFF further clarified that jailbreaking the iPhone is not related to protecting Apple software from piracy.

EFF cited the example of Apple rejecting applications on the ground that they compete with Apple’s own software. This move, according to the firm is detrimental to innovation and healthy competition for the developers’ community. Jailbreaking the iPhone will give individuals and developers to choose for themselves what to develop and what to have on their devices.

As part of the filing the firm invites iPhone app developers to share their views about the frustration of the existing app approval process and support the move initiated to legalize iPhone jailbreaking.

Legalizing will spoil the whole fun of jailbreaking. Do you think EFF really need to fight for this?
